Acceptable Use Policy
Clear usage boundaries to keep the network safe, compliant, and sustainable.
1. Purpose & Scope
This Acceptable Use Policy (AUP) defines the permitted and prohibited uses of the XPayr platform. It applies to all users, merchants, and entities that access or interact with XPayr services.
XPayr operates as a non-custodial smart contract routing software provider. While we do not control or process payments directly, we are committed to ensuring that our infrastructure is not used for unlawful, harmful, or unethical purposes.
By using the XPayr platform, you agree to comply with this policy in its entirety. Violation of any provision may result in immediate action, including account suspension or termination, without prior notice.
2. Prohibited Business Categories
The following business categories are strictly prohibited from using the XPayr platform:
Illegal or Unlicensed Gambling & Betting: Unlicensed online casinos, sports betting, lotteries, fantasy sports with real-money stakes, wagering services, or any gambling activity that is unlawful in the jurisdiction where the operator, customer, or activity is located.
Adult Content Where Prohibited: Pornography, escort services, adult dating, sexually explicit content, and related services where such activity is unlawful, unlicensed, or violates platform policy.
Controlled Substances: Cannabis, CBD products (where legally restricted), recreational drugs, drug paraphernalia, and unregulated pharmaceutical products.
Securities & Financial Instruments: Unregistered securities offerings, initial coin offerings (ICOs) without proper compliance, leveraged trading platforms, binary options, and pyramid or Ponzi schemes.
Unlicensed High-Risk Trading: Margin trading platforms, forex without proper licensing, unregulated derivatives, and any financial products that pose significant consumer risk.
Weapons & Ammunition: Firearms, ammunition, explosives, tactical weapons, and any military or law enforcement equipment.
Counterfeit & Infringing Goods: Counterfeit products, pirated software, replica luxury goods, and any items that infringe on intellectual property rights.
This list is not exhaustive. XPayr reserves the right to reject or terminate any account that, in our sole discretion, poses an unacceptable risk to the platform or its users.
3. Prohibited Activities
In addition to prohibited business categories, the following activities are strictly forbidden on the XPayr platform:
Fraud & Deception: Creating fake payment links, conducting phishing attacks, impersonating other entities, or engaging in any form of deceptive business practices.
Money Laundering & Terrorism Financing: Using the platform to launder proceeds of crime, finance terrorism, or circumvent sanctions, as detailed in our AML/KYC Policy.
Structuring: Deliberately splitting transactions to avoid detection thresholds or reporting requirements.
Price Manipulation: Artificially inflating or deflating the price of digital assets through wash trading, spoofing, or other manipulative practices.
Unauthorized Access: Attempting to access other users accounts, exploit platform vulnerabilities, or interfere with the normal operation of the XPayr infrastructure.
Spam & Abuse: Using XPayr APIs or services for unsolicited communications, automated abuse, or any activity that degrades platform performance or user experience.
Circumvention: Attempting to bypass geographic restrictions, sanctions screening, or any other platform controls through VPNs, proxies, or other technical means.
4. Merchant Obligations
Merchants using the XPayr platform have additional obligations beyond those of regular users:
Legal Compliance: You are solely responsible for ensuring that your business, products, and services comply with all applicable laws and regulations in every jurisdiction where you operate.
Accurate Representation: Product descriptions, pricing, and business information must be accurate, truthful, and not misleading. False advertising or bait-and-switch tactics are prohibited.
Customer Communication: You must provide clear and accessible contact information, refund policies, and terms of sale to your customers.
Tax Compliance: You are solely responsible for calculating, collecting, and remitting any applicable taxes on your transactions. XPayr does not provide tax advice or handle tax obligations on behalf of merchants.
Data Protection: If you collect personal data from your customers through payment pages or APIs, you must comply with all applicable data protection regulations and maintain appropriate security measures.
5. High-Risk & Regulated Merchant Review
Certain legal business categories may still require enhanced review before mainnet activation. These may include licensed iGaming, casino, poker, betting, contests, adult services, trading platforms, and other regulated or high-risk sectors.
Testnet Access: Merchants may use the XPayr testnet environment to evaluate checkout, API, webhook, and dashboard behavior without real payment activity.
Mainnet Activation: Mainnet access for high-risk or regulated sectors is not automatic. XPayr may request business information, license or registration evidence, operating domains, supported jurisdictions, restricted-market controls, AML/fraud procedures, wallet configuration, and expected transaction volumes before production access is enabled.
Licensed Operators Only: For iGaming, casino, poker, betting, lottery, tournament, contest, or similar wagering-related businesses, XPayr may support only operators that can demonstrate lawful operation in their target jurisdictions. Unlicensed or unlawful gambling activity remains prohibited.
Ongoing Review: XPayr may apply limits, monitoring, additional verification, or account restrictions to high-risk merchants and may suspend access if the use case changes or no longer meets platform policy.
6. Enforcement & Consequences
XPayr actively monitors platform usage and investigates reported violations of this Acceptable Use Policy.
Detection: We employ automated monitoring systems, manual reviews, and user reports to detect policy violations. We may also use blockchain analytics providers to identify suspicious activities associated with prohibited categories.
Graduated Response: Depending on the severity and nature of the violation, XPayr may take one or more of the following actions: issue a warning and request corrective action, temporarily suspend account functionality, permanently terminate the account and revoke API access, report the violation to relevant law enforcement or regulatory authorities.
No Prior Notice: In cases of severe violations, including fraud, sanctions evasion, or activities that pose an immediate risk to the platform or its users, XPayr may take immediate action without prior notice.
Appeal Process: Users who believe their account was actioned in error may submit an appeal by contacting support. Appeals will be reviewed by the compliance team and a response will be provided within a reasonable timeframe.
XPayr may request additional evidence or documentation at any time to verify lawful and compliant use of the platform.
7. Reporting & Contact
If you become aware of any use of the XPayr platform that violates this Acceptable Use Policy, we encourage you to report it.
How to Report: Send a detailed report to [email protected] including the nature of the suspected violation, any relevant payment links, wallet addresses, or transaction hashes, supporting evidence or screenshots, and your contact information (optional but helpful for follow-up).
Confidentiality: Reports are treated confidentially. We will not disclose the identity of the reporter to the subject of the report unless required by law.
Policy Updates: This Acceptable Use Policy may be updated from time to time to reflect changes in regulations, industry standards, or platform capabilities. Material changes will be communicated through the platform.
